DUI/DWI EDUCATION PROGRAMS IN NEW YORK CITY
(AND THE SURROUNDING COUNTIES)
After arrest and arraignment for a DWI, it is a law in New York State that the motorist must get an alcohol evaluation and assessment at a court certified alcohol counseling center. Court certified means that the alcohol counseling facility is O.A.S.A.S. certified. O.A.S.A.S., stands for Office of Alcohol and Substance Abuse Services. After you get assessed at an O.A.S.A.S. center, the alcohol counselor will determine if the motorist requires additional counseling.
At the initial visit, an interview is conducted to determine the motorist’s drinking patterns and drinking history. Usually an independent party (such as a spouse, for example) is required to verify the information obtained in the interview. Also, a urine test may be required to see if the motorist has recently taken drugs or alcohol. If the counselor determines that the motorist has no drinking problem, no follow up sessions will be required. If the motorist is determined to have a drinking problem, follow up sessions may be required. There is a cost for getting the alcohol assessment and evaluation, which varies somewhat from O.A.S.A.S. facility to O.A.S.A.S. facility. Many health insurance plans cover some or all the cost of the visit(s) to the facility. When you contact the O.A.S.A.S. facility of your choosing, inquire about costs, whether insurance is accepted, and whether you have to bring someone to the interview. Many facilities will require payment, and provide the necessary forms for reimbursement from your insurance company.
If your car is seized in New York City by the police in conjunction with a DWI arrest, the NYPD Legal Bureau will probably require an O.A.S.A.S. alcohol assessment to get your car back. (Among other requirements – assuming a settlement is reached where the NYPD will return your car without the need for a hearing.) This alcohol assessment is independent of the assessment required by the criminal court. However, the same O.A.S.A.S. counselor can perform the same alcohol assessment which will suffice for both the NYPD Legal Bureau, and the New York City (or County) Criminal Court. (Be aware that the form the O.A.S.A.S. counselor fills out for criminal court is different from the form filled out for the NYPD Legal Bureau.)
